I thought I’d just give you a quick update on evicting tenants under Section 8 & Section 21 notices.
Last the week the government announced that tenants could not be evicted until August 23 which means if you currently have a Section 8 or 21 notice and are trying to gain possession of your property, the earliest date you can do this is August 23rd.
They haven’t amended the fact that landlords must still give at least 3 months’ notice (rather than 2) before they can apply to court for possession. This also applies regardless of which ground is used under Section 8.
So if you serve a notice today then the earliest you can apply to the court will be September, undoubtedly they’ll be a back-log, so if you are having a problem with your tenant then it would be best to act sooner rather than later.
We currently use outside legal advice to make sure our notices are legally compliant whereas normally we’d do a Section 21 ourselves.
